Alcoholic Beverage Licensing

The City of Magnolia does not have applications for alcoholic beverage licensing. Applications are available through Texas Alcoholic Beverage Commission ("TABC") who regulates the production, distribution and sale of alcohol within the State of Texas receiving their authority to do so from the Texas Alcoholic Beverages Code.

Alcohol permit submittal process:

  • Applicant retrieves application from TABC website
  • Applicant submits application to Interim City Secretary Don Doering at City Hall
  • City verifies distance from zoning; certifies the application in 5-7 days
  • Applicant and TABC process the remainder of the application; TABC estimates 6-8 weeks for approval

Distance Requirements:

In general, no alcoholic beverage may be sold within three hundred (300') feet of a school, church or public hospital. The Texas Alcoholic Beverages Code and City of Magnolia Ordinance No. O-2012-015 establish the manner by which these distance requirements are measured. The following illustrations may help clarify these provisions:

Church and Public Hospital Distance Requirements

The measurement of the distance between the place of business where alcoholic beverages are sold and a church or public hospital shall be along the property lines of the street fronts and from front door to front door, and in a direct line across intersections.

School Distance Requirements

The measurement of distance between the place of business where alcoholic beverages are sold and a public or private school shall be in a direct line form the property line of the public or private school to the property line of the place of business, and in a direct line across intersections.

Any person desiring a variance as provided in O-2012-015 Sec. 6-4, subsections (b) or (c) shall file with the City Secretary a written request for a hearing before the city council. The city secretary shall place such request upon the agenda of the city council for its regular meeting next following the expiration of 15 days from the date of filing of the request by the applicant, and shall, at least ten days prior to the date of such hearing.

Are childcare facilities included in the distance requirements?
Childcare facilities are not included in the distance requirements. By State law, spacing requirements only apply to Public and Private Schools, Churches or Public Hospitals.

Can Churches or Schools petition for increased distance requirements to one thousand (1,000’) feet?
No. The Texas Education Code only allows cities over a population of 900,000 to increase the distance requirements to 1,000 feet.

What are the legal hours within the City of Magnolia to sell alcohol?
Restaurants may serve alcoholic beverages during the following hours:

  • Monday - Friday from 7 a.m. to 12 Midnight
  • Saturday from 7 a.m. to 1 a.m. (Sunday)
  • Sunday from 10 a.m. to 12 Noon with food; and 12 Noon to Midnight

The holder of a late hours permit from the TABC may also serve from 12 Midnight to 2 a.m. on any day.

Convenience Stores or Grocery Stores may sell alcohol during the following hours:

  • Monday - Friday from 7 a.m. to 12 Midnight
  • Saturday from 7 a.m. to 1 a.m. (Sunday)
  • Sunday from 12 Noon to 12 Midnight

Liquor stores may sell alcohol during the following hours:

  • Monday - Saturday from 10 a.m. to 9 p.m.
  • Liquor stores are prohibited from selling liquor on New Year’s Day, Thanksgiving Day and Christmas Day. If New Year’s Day or Christmas Day fall on a Sunday, then the prohibition applies to the following Monday.
